Kahnawake Jurisdiction

It is very interesting that most regulatory agencies for the online gaming industry are located in rather remote areas all over the world. None of these agencies could be as remote as the Kahnawake Gaming Commission located within the Mohawk Territory of Kahnawake, which is in the province of Quebec, Canada.

In 1996, the Mohawk Council of Kahnawake established the Kahnawake Gaming Commission as part of the Kahnawake Gaming Law. Furthermore, the Mohawk Counsel responded to the need for regulations related specifically to the online gaming industry by establishing their "Regulations concerning Interactive Gaming" in 1999. This gave the gaming commission a platform from which they could begin issuing licenses for all types of remote gambling. While the Canadian Government has no regulatory agencies related to online gambling, the Mohawk Counsel derives its authority through the autonomy granted to Indian Nations by the Canadian government. In this capacity, the Kahnawake Gaming Commission oversees all licensing and regulatory guidelines related to both online gaming and land-based gaming. In 2007, the commission passed its "Regulations concerning Poker Rooms", followed by Regulations concerning Raffles passed in 2011. The Kahnawake Gaming Commission has no authority over the horse racing industry in Canada. T&C's apply to all bonus offers on this site. Click for a list of all jurisdictions.

Kahnawake Gaming Commission

Technological Control & Highly Rated

The are an estimated 50 or so online gaming operators who have registered with the Kahnawake Gaming Commission. These operators are running approximately 250 individual online gaming sites through this jurisdiction. In order to be approved under the commission's guideline, these sites are required to host its infrastructure at Mohawk Internet Technologies, which is managed by a group named Continent 8 Technologies. By taking control of the technology related to these online sites, the Kahnawake Gaming Commission is able to assure consistency and conformity to all the necessary rules and regulations it has issued.

Why Kahnawake?

Kahnawake has proven to be a key regulatory player with the online gaming industry for two reasons. First, Canada's constitution is responsible for giving Indian tribes autonomy on their own lands. While Canada is a fiscally conservative nation that may resort to unreasonable laws if it were to control online gaming, the Indian counsels are able to apply a more liberal view. Secondly, Indian related operations fall under special tax guidelines that would be considered favourable to the gaming industry.

Key Regulations

In establishing its rules and regulations, the Kahnawake Gaming Commission has developed guidelines for both operators and players. For operators, all authorized operators must be approved to carry one of four different types of licenses. Once licensed, the operators must submit to random audits and investigations to be performed by independent agents authorized to work on behalf of the commission. These agents include eCOGRA, TST and iTech Labs. For the benefit of players, the site is required to operate in a "fair and honest" manner. They must have a mechanism in place to protect minors and individuals prone to compulsive gambling issues. This mechanism must also include a process where people "close" to the gambler can petition to have controls placed over the player's gambling. Finally, player confidentiality must be protected at all times.
