Introduction of the Legal Regime of the Games and Online Gaming
In June of 2015, the Portuguese Government established online gambling as a legal endeavour with the passing of the Decree-Law No. 66/2015. Under the provisions of the law, the Legal Regime of the Games and Online Gaming (ROJ) was established to serve as the government's jurisdictional watchdog for both online iGaming sites and the country's existing land-based casinos.
The powers granted to the ROJ included responsibility for the licensing of online site operators and iGaming software providers, monitoring of online operations and the resolution of disputes between operators and customers. The primary objectives of the new degree and the ROJ include the protection of minors, fraud and money laundering prevention, determent of criminal activity and maintaining the integrity of the games and sports being used as products for gaming.
The Licensing Process
Under the provisions established by law, owners/operators may apply for an iGaming license that shall be maintained for a period of three years. In order to qualify for said license, the owner/operator must submit documentation to be used to establish the legal capacity to operate an online gaming site, the character of the site's management, the ability to technically support a site and the economic stature to handle any and all financial responsibilities that may arise.
Finally, the site's owner is required to pay a licensing fee and submit to the rules of taxation for Portugal and/or the state(s) in which ownership is maintained.
Forms of Online Gaming Covered
Based on the provisions of the law, licensing covers all games of chance. This includes slots, table games (craps, baccarat, roulette and blackjack), bingo, poker, pari-mutual and fixed-odds horse racing and sports betting. It's worth noting that the ROJ is also responsible for the oversight of games offered in a land-based casino environment, of which there are currently 11 in operation.
Protection of Its Citizens
At all times, the ROJ is responsible for the protection of its citizens from predatory marketing and gaming practices. Each online operator is responsible for the establishment of a "Responsible Gaming Policy" that is to be supported by access to help sites for problem gamblers (ie: Gambles Anonymous or LifeLine). Additionally, each site is required to permit its players to have an opportunity to request self-exclusion from the site.
