The UK Gambling Commission
In 2005, the UK Parliament passed a law that established the UK Gambling Commission. Initially, the Commission's main body of responsibility was the licensing and oversight for all forms of commercial gambling except the National Lottery and remote (online) gambling.
In October 2013, responsibility for the National Lottery sector was aligned under the UK Gambling Commission's area of responsibility. Finally, the Gambling (Licensing and Advertising) Act 2014 was enacted in November of 2014.
Under this new law, any online casinos that sought to advertise and/or provide services to UK citizens were required to register and receive licensing from the Commission, effectively giving the Commission oversight of that sector as well.
The primary goals of the UK Gambling Commission include monitoring gambling activities to create a crime-free environment, assure that all gaming results are fair and honest and to provide protection to minors and problem gamblers who might be vulnerable to certain industry practices and forms of advertising.
The Commission provides provider oversight for compliance of all rules and regulations plus licensing for all forms of commercial gambling. It should be noted the Commission is not responsible for handling consumer complaints against providers nor will they provide legal advice.
It is the responsibility of each provider to put in place procedures for complaints and incumbent on players to make sure they are comfortable with those procedures before they use the services.
Licensing and Compliance Guidelines
With the explosion in online gambling over the past few years, the UK Gambling Commission saw a significant rise in complaints related to online gambling practices and advertising.
In order to properly protect its citizens, the new Gambling Act law required that any provider wishing to provide services and/or advertise in the UK must obtain a license and adhere to certain regulations.
Some of the primary regulations include:
- All sites must be properly licensed before providing services. Applications require background checks and financial stability analysis.
- Each site is required to use software provided by licensed software providers.
- All software is subject to testing and certification for fairness.
- Dedicated UK bank accounts are required for holding player funds.
- Players under 18-years of age must be prohibited from gambling.
- Access to help for problem gamblers must be advertised on the site.
- Sites must provide audited financial information on a periodic basis.
- Site security is required to undergo testing and certification procedures.
- Predatory advertising practices will not be permitted.
